Can You Legally Make and Sell Spotify Products?

Recently, Spotify products have become hot sellers in the handmade craft market. As always, my first thoughts were about the legality of making and selling products using screenshots of Spotify, Spotify codes, or the Spotify logo.

I reached out to Spotify for an official statement after hearing rumors that Spotify was having infringing products removed from marketplaces.

Official Statement from Spotify

I asked Spotify three specific questions: 1) Can you sell products with screenshots of Spotify on them? 2) Can you sell products with Spotify Codes on them? 3) Can you sell products with Spotify logos on them?

Here is the official statement/reply I received from Spotify:

We understand that you’d like to look for information when doing crafts related to Spotify.

As laid out in our Terms and Conditions, Spotify is for personal entertainment only and not for commercial use.

If you are interested in reading the Terms and Conditions, they are relatively short. Pay particular attention to these passages on page one:

What About the Brand Guidelines?

A few crafters have come across the brand guidelines for Spotify, located at this link. These are guidelines for brands to use in marketing (posters, websites, etc), and are not applicable to creating products to sell.

Similarly, there is a FAQ on Spotify’s site about placing codes on physical products. If you read the FAQ carefully, you’ll see that before emailing for permission from Spotify, you’ll want to be sure that your product meets the ‘Brand Guidelines’. Again, this FAQ is geared towards artists and brands – not crafters.

What Does All This Mean for Small Business Sellers?

Spotify has clearly stated that you cannot make and sell Spotify related products.

    I am guessing you meant Shopify??? If not, I don’t understand this post.
